Found, Recovered and Stolen Property

Brian Heino, Sheriff of Flathead County, hereby gives notice pursuant to Montana Code Annotated (25-13-701 MCA) of his intention to dispose of certain property described as follows:

The Sheriff intends to donate property to charitable organizations, retain the property for use by the unit of government, surrender such property to the finder, trade the property to another unit of government or state agency or sell the property at a Sheriff’s Sale. Persons wishing to lay claim to property may do so by calling and scheduling an appointment at the Sheriff’s Office at (406)758-5692. Office hours are from 8:00 A.M. to 5:00 P.M. Monday through Friday.

FOUND PROPERTY

Found Property turned into the Flathead County Sheriff’s Office will be posted on this website for a period of 90 days.  At the end of the 90 days if an owner is not identified the property will be disposed of pursuant to MCA Code Annotated 25-13-704. Conduct of sale.

70-5-103. Duty to inform owner when known. If a person finds money, goods, things in action, or other personal property or saves a domestic animal from drowning or starvation when the property is of a value of $10 or more and the person knows or suspects who the owner is, the person shall use reasonable diligence to inform the owner and make restitution without compensation, further than a reasonable charge for saving and taking care of the property. If the person fails to do so, the person is liable in damages to the owner and does not have a claim to any reward offered by the owner for the recovery of the thing or to any compensation for the person’s trouble or expenses.

70-5-104. Right of finder to require proof of claimant’s ownership. The finder of a thing may in good faith before giving it up require reasonable proof of ownership from any person claiming it.
